Acceptance of Terms

  • By downloading, installing, or using Schuss, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.
  • We may update these Terms from time to time. Continued use after changes constitutes acceptance. We will notify you of material changes via email or in-app notification.

Eligibility

  • You must be at least 13 years old to use Schuss. If you are under 18, you must have parental or guardian consent.
  • You are responsible for maintaining the security of your account credentials.

Your Account

  • You are responsible for all activity that occurs under your account.
  • You agree to provide accurate and complete information when creating your account.
  • You may delete your account at any time from Profile → Settings → Delete Account. Deletion is permanent.

Acceptable Use

  • Use Schuss for its intended purpose: tracking your skiing and snowboarding activity, coordinating with friends on the mountain, and reviewing your session statistics.
  • Do not use Schuss to stalk, harass, or monitor anyone without their explicit consent.
  • Do not attempt to reverse-engineer, decompile, or extract source code from the app.
  • Do not use automated systems or bots to interact with Schuss.
  • Do not impersonate other users or misrepresent your identity.

Location Data & Safety

  • Schuss uses GPS to provide real-time location features. GPS accuracy varies based on device, terrain, weather, and satellite availability.
  • Schuss is not a safety device. Do not rely on Schuss as your sole means of navigation, avalanche safety, or emergency communication.
  • Always follow resort safety guidelines, ski patrol instructions, and local regulations regardless of what Schuss displays.
  • Speed and distance measurements are approximations. Do not use them to make safety-critical decisions.

Social Features & Friend Sharing

  • When you join a party, your real-time location and activity are shared with party members. You can leave a party at any time to stop sharing.
  • You are responsible for the content you share through Schuss, including profile information and any messages.
  • We reserve the right to remove content or suspend accounts that violate these Terms or are reported for abuse.

Intellectual Property

  • Schuss, including its design, code, trail maps, and branding, is owned by Schuss. All rights reserved.
  • Your session data (runs, stats, routes) belongs to you. You grant us a license to store and process it to provide the service.
  • You may export your data at any time by contacting support@schuss.app.

Subscriptions & Payments

  • Certain features of Schuss may require a paid subscription. Pricing and features are described in the app.
  • Subscriptions are billed through Apple's App Store. Refunds are handled by Apple per their refund policy.
  • You can manage or cancel your subscription at any time through your device's subscription settings.

Service Availability

  • We strive to keep Schuss available and reliable, but we do not guarantee uninterrupted service.
  • We may temporarily suspend service for maintenance, updates, or circumstances beyond our control.
  • Features may change over time as we improve the app. We will communicate significant changes in advance when possible.

Limitation of Liability

  • Schuss is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any injuries, accidents, or damages that occur while using Schuss or relying on its data.
  • Skiing and snowboarding are inherently dangerous activities. You assume all risks associated with your participation.
  • Our total liability to you for any claim arising from your use of Schuss is limited to the amount you paid for the service in the 12 months preceding the claim.

Termination

  • We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to other users or the service.
  • You may terminate your account at any time by deleting it from the app.
  • Upon termination, your right to use Schuss ceases immediately. Data deletion follows our Privacy Policy.

Governing Law

  • These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
  • Any disputes shall be resolved through binding arbitration in San Francisco, California, except where prohibited by law.
